This study
examines the evolving role of mental health and psychiatric nursing, focusing
on the authority and boundaries of advanced practice nursing in psychotherapy.
Within a comparative legal framework, the transition from Peplau’s
interpersonal process to structured modalities is analyzed across diverse
jurisdictions, including the US, the UK, and various EU countries. The research
highlights the critical importance of title protection, professional
competence, and the scope of practice in defining the nurse psychotherapist’s
role. Significant attention is given to the legal liability and ethical
boundaries associated with autonomous practice, particularly in therapeutic
risk management and informed consent. By comparing international regulatory
standards, such as those of the ANA and NMC, the study addresses the
legislative gaps and the necessity for clear statutory bases for psychiatric
nurses. Ultimately, it emphasizes that establishing robust legal and ethical
frameworks is essential for ensuring patient safety and professional
accountability in psychiatric care.
