Özet

Rehin Cirosunda Teminat İşlevi

                Temlik cirosunda mevcut bulunan teminat işlevi ile her ciranta kendisinden sonra gelenlere ve hamile karşı senedin kabul edilmemesinden ve ödenmemesinden sorumludur (TTK m. 685/1). Ülkemizde özellikle bankacılık uygulamasında sık rastlanılan rehin cirosunun (TTK m. 689) teminat işlevine sahip olup olmadığı, dolayısıyla ciro edilenin (rehnalan hamilin) koşullar oluştuğunda kendi cirantasına (rehneden cirantaya) kambiyo senedi kurallarına göre başvurup başvuramayacağı ise, konuya ilişkin herhangi bir kanuni düzenlemenin mevcut olmaması nedeniyle tartışmalıdır. Öğretideki hakim görüşe göre, rehin cirosunda teminat işlevi bulunmamaktadır. Zira rehin cirosunda hamil, yalnızca bir rehin hakkı kazanmakta olup, senedin mülkiyetini iktisap etmemekte ve böylece hiçbir zaman senedin alacaklısı durumuna geçmemektedir. Buna göre, kambiyo senedini rehin cirosu ile iktisap eden hamil kendi cirantasına kambiyo senedine dayanarak senet bedelinin tahsili amacıyla başvuramayacaktır. Nitekim Yargıtay kararları da bu yöndedir. Aksi görüşe göre ise, rehin cirosunda rehneden ciranta, bir borcunu temin maksadıyla senedi devretmektedir. Bu bakımdan senedin kabul edileceğine ve ödeneceğine dair rehnalan hamile bir garanti vermiş olması gerekir. Bu halde senet kabul edilmediği veya ödenmediği zaman rehneden cirantaya kambiyo senedi kurallarına göre başvurulabilecektir. Elbette farklı gerekçelerle de rehin cirosunda teminat işlevinin bulunduğu veya bulunmadığı savunulmuştur.

                Bu tebliğimizde hem eşya ve borçlar hukukunu hem de kambiyo senedi hukukunu ilgilendiren, teori ve uygulama açısından önem arz eden ve oldukça tartışmalı olan rehin cirosunda teminat işlevi, öğreti görüşleri ve yargı kararları ışığında neden-sonuç ilişkisi bağlamında hareket edilerek incelenecektir.

Collateral Function in Endorsement of Pledge

It has the capacity of insurance in task endorsement. Here, every girante is liable for the disapproval and non-installment of the deed against the individuals who come after him and the holder (TCC Art. 685/1). In our country, endorsement of pledge is regular particularly in banking practice (TCC Art. 689). Regardless of whether the vow endorsement has a security work is dubious. Along these lines, it is likewise dubious whether the endorser (the holder who secures with a pledge) can apply for his support (the vow underwriting) as indicated by the standards of the bills of exchange. Since there is no lawful guideline regarding the matter. As per the prevailing perspective in the precept, there is no assurance work in the vow endorsement. Since in the endorsement of pledge, the holder just increases a vow right. The holder doesn't obtain the title of the note and never turns into a bank of the note. Appropriately, the holder who gains the bill of exchange with the vow support won't have the option to apply to his underwriting for the assortment of the bill sum dependent on the bill of exchange. In actuality, the choices of the Supreme Court are toward this path. As indicated by the contrary view, the pledging endorser moves the bond so as to make sure about an obligation in the vow's endorsement. In such manner, the pledgee more likely than not given a holder assurance that the deed will be acknowledged and paid. For this situation, when the deed isn't acknowledged or paid, the vow support can be applied by the principles of the bill of exchange. Obviously, for various reasons, it has been contended that there is or doesn't have a security work in the vow endorsement.

In this paper, the capacity of insurance in the endorsement of pledge, which concerns both the law of merchandise and commitments and the law of bills of exchange, which is significant as far as hypothesis and practice and is profoundly disputable, will be inspected with regards to cause-impact relationship in the light of doctrinal perspectives and legal choices.
