Özet

Edinilmiş mallara katılma rejimini sona erdiren sebepler ve bu mal rejiminin sona erme anı 4721 sayılı Türk Medeni Kanunu m. 225’te düzenlenmiştir. Maddede belirtildiği üzere “Mal rejimi, eşlerden birinin ölümü veya başka bir mal rejiminin kabulüyle sona erer./ Mahkemece evliliğin iptal veya boşanma sebebiyle sona erdirilmesine veya mal ayrılığına geçilmesine karar verilmesi hâllerinde, mal rejimi dava tarihinden geçerli olmak üzere sona erer.”.

Çalışmamızda edinilmiş mallara katılma rejimini sona erdiren sebeplerden birinin söz konusu olduğu durumlarda, mal rejiminin hangi andan itibaren sona ereceği inceleme konusu yapılmıştır.

Reasons for dissolution of regime of participation in acquired property and time of dissolution of this regime are stipulated by Turkish Civil Code No 4721 in article 225. According to this article “Regime of participation in acquired property is dissolved on the death of a spouse or on implementation of a different regime./ In the case of divorce, annulment of the marriage or a court order for separation of property, the dissolution of the regime of participation in acquired property takes retroactive effect as of the date on which the application is filed.”.

In our study, the moment of dissolution of property regime - in cases where one of the reasons for the dissolution of regime of participation in acquired property is in question - is examined.
