Özet

Yapay zekâ, salt düşünce üreten modellerden, dış dünya ile etkileşim kurabilen ve otonom şekilde eyleyebilen yapay zekâ ajanlarına evrilmektedir. Bu evrim, yapay zekâyı artık pasif bir araç olmaktan çıkarıp aktif bir "eyleyen" konumuna getirmekte ve mevcut hukuk sistemleri için ciddi sınamalar doğurmaktadır. Bu çalışma, yapay zekâ ajanlarını merkezi ve merkezsiz olarak ikiye ayırmakta ve özellikle dağıtık defter teknolojileri üzerinde çalışan, durdurulması teorik olarak imkânsız hale gelebilen merkezsiz ajanların yarattığı hukuki boşlukları ele almaktadır.

Merkezsiz ajanların ortaya çıkışıyla birlikte, hukuki statü, sorumluluğun atfedilebilirliği, yargı yetkisi ve sözleşme ehliyeti gibi temel hukuki kavramlar yetersiz kalmaktadır. Bu ajanların, merkezi bir otoriteden bağımsız olarak kripto varlık cüzdanları yönetebilmesi, bir zarar meydana geldiğinde sorumluluğun kime yükleneceği ve mahkeme kararlarının nasıl icra edileceği gibi konularda mevcut hukuk sistemleri için bir "sorumluluk boşluğu" yaratma riski taşımaktadır. Çalışma, merkezi sistemlerde dahi (örneğin askeri hedefleme sistemlerinde) kontrolün ne denli zorlaştığını güncel örneklerle ortaya koyarak, merkezsiz sistemlerin potansiyel risklerinin altını çizmektedir.

Bu bağlamda, sorumluluğun sadece kullanıcıya veya üreticiye atfedildiği geleneksel yaklaşımların ötesine geçilmesi gerektiği savunulmaktadır. Çözüm olarak, merkezsiz yapay zekâ ajanlarının hukuki bir gerçeklik olarak tanınarak, onlara yönelik 'özel bir hukuki statü' veya 'dijital temsilci' gibi yenilikçi hukuki kurumların geliştirilmesi ihtiyacı vurgulanmaktadır. Bu, hem hak kayıplarının önüne geçilmesi hem de teknolojinin gelişiminin insanlık onuruna ve güvenliğine uygun bir çerçevede ilerlemesi için zorunludur.

Artificial intelligence is evolving from models that merely generate thought to AI agents capable of interacting with the external world and acting autonomously. This evolution transforms AI from a passive tool into an active 'actor,' posing significant challenges for existing legal systems. This study categorizes AI agents as centralized and decentralized, focusing specifically on the legal voids created by decentralized agents that operate on distributed ledger technologies and can, in theory, become impossible to shut down.

With the emergence of decentralized agents, fundamental legal concepts such as legal status, attribution of liability, jurisdiction, and contractual capacity are rendered inadequate. The ability of these agents to manage crypto asset wallets independent of a central authority, raises critical questions about who can be held liable when harm occurs and how court decisions can be enforced, posing a significant risk of creating a 'liability gap' within existing legal frameworks. By demonstrating through current examples - such as in military targeting systems - how control is becoming increasingly difficult even in centralized systems, the study underscores the potential risks of decentralized ones.

In this context, it is argued that traditional approaches, which attribute liability solely to the user or manufacturer, must be transcended. As a solution, the paper emphasizes the need to recognize decentralized AI agents as a legal reality and to develop innovative legal constructs for them, such as a 'special legal status' or a 'digital representative.' This is imperative both to prevent the loss of rights and to ensure that the development of this technology proceeds within a framework consistent with human dignity and security.
