Özet
Borç ilişkisinde borcun amacı alacaklının tatmin edilerek borcun sona ermesidir. Bu amaçtan hareketle modern hukuk üçüncü kişilerin borç ilişkisine müdahalelerini kabul etmektedir. Üçüncü kişilerin borç ilişkisine dahil olması ile çözülmesi gereken hukuki problemler ortaya çıkmaktadır. Bu sorunlardan ilki başkasının borcunu ödeyen üçüncü kişinin korunmasıdır. Halefiyet, borcun başkası tarafından ifa edilmesi halinde alacaklının haklarının halef olan kişiye geçmesi olup, üçüncü kişinin korunmasını sağlamaktadır. Borcun tamamını ödeyen borç ilişkisine dahil olmayan bir üçüncü kişinin borçtan sorumlu kimselerin (örneğin kefilin) bu ödemeden dolayı meydana gelen zararın giderilmesi ve ödemede bulunan lehine doğacak talep hakkını hukuk düzenleri denkleştirme yapma suretiyle çözmeye çalışmıştır. Bu çözüm ise rücu ile mümkündür. İpotek ve kefalet sözleşmeleri ise borç ilişkisi teminat altına alan iki ayrı hukuki imkândır. İpoteğin üçüncü kişi tarafından verilmesi halinde, taşınmaz malikinin alacaklıyı tatmin etme yetkisi vardır. Malik alacaklıyı tatmin edince, halefiyet ve rücu hakkı gündeme gelir. Kefil ise alacaklıyı tatmin ettiğinde, borçluya rücu etmek için hem halefiyete dayanan hem de iç ilişkiye dayanan rücu hakkı bulunmaktadır. Halefiyet ile rücu malvarlığında kayıp yaşayan üçüncü kişinin bu kaybı gidermesini amaçladığı için birbiri ile oldukça ilişkili kavramlar olmasına rağmen aynı anlamda da değillerdir. Halefiyetin rücu ile ilişkisinin kurulması gereklidir. Nitekim rücu hakkı daha geniş bir kavram olup, kimi zaman halefiyetin neticesinde doğmakta, kimi zaman ise rücu hakkı kanun tarafından sağlanarak halefiyet ile bu rücu hakkı kuvvetlendirilmektedir. Bu çalışmada amaç, halefiyet ve rücunun birbiri ile ilişkisini ortaya koymaktır. İpotek ve kefalet sözleşmeleri özelinde de halefiyet ile rücunun ilişkisi çerçevesinde, halefiyete ilişkin özel hükümlerde aranan şartlar ve halefiyetin sonuçları incelenmektedir.
n an obligatory relationship, the purpose of the debt is the satisfaction of the creditor and the subsequent discharge of the obligation. Based on this objective, modern law accepts the intervention of third parties in obligatory relationships. The involvement of third parties in an obligatory relationship gives rise to legal problems that must be resolved. The first of these issues is the protection of the third party who pays the debt of another. Subrogation refers to the transfer of the creditor's rights to the person who succeeds them in the event that the debt is performed by another, thereby ensuring the protection of the third party. Legal systems have attempted to achieve an equalization by resolving the right of claim that arises in favor of a third party, who is not a party to the obligatory relationship but pays the debt in full, for the indemnification of the loss incurred against those liable for the debt (e.g., the guarantor). This solution is made possible through the right of recourse. Mortgage and suretyship contracts are two distinct legal instruments that secure the obligatory relationship. In cases where a mortgage is provided by a third party, the owner of the immovable property has the authority to satisfy the creditor. Upon the owner's satisfaction of the creditor, the rights of subrogation and recourse come into play. Similarly, when a surety satisfies the creditor, they possess a right of recourse against the debtor, based both on subrogation and the internal relationship. Although subrogation and recourse are closely related concepts, as both aim to compensate the loss sustained by the third party who suffers a diminution in assets, they are not synonymous. It is necessary to establish the relationship between subrogation and recourse. Indeed, the right of recourse is a broader concept; it sometimes arises as a consequence of subrogation, while at other times, the right of recourse is provided by law and subsequently reinforced by subrogation. The objective of this study is to reveal the relationship between subrogation and recourse. Within the specific context of mortgage and suretyship contracts, the conditions required under special provisions regarding subrogation and the consequences of subrogation are examined through the framework of the relationship between subrogation and recourse.
